Masimo Has Spent ‘Around $100 Million’ In Its Patent Violation Fight Against Apple; CEO Says He Was Warned, Called Crazy For His Efforts

The recent Apple Watch sales ban in the U.S. was thanks to the efforts of Masimo, a health technology firm that claims Apple uses stolen technology in its latest smartwatch models. Though Masimo has found some measure of success against the most valuable company in the world, the journey has been harrowing, both mentally and financially, with CEO Joe Kiani stating that around $100 million has already been spent in its legal battle.
Apple has managed to obtain some temporary relief as the U.S. Court of Appeals for the Federal Circuit has lifted the ban until January 10, but every passing day appears to be a victory for Masimo. In an interview with the Wall Street Journal, Kiani mentions that an obscene amount has already been spent in attempting to force an Apple Watch sales ban in the U.S.
However, Kiani has only been able to prevent the sales of the Apple Watch Series 9 and Apple Watch Ultra 2, as these two feature a blood oxygen monitor, which is technology that Masimo claims was stolen by Apple. Earlier iterations of the Apple Watch can still be purchased in the U.S., which means that revenue in the millions will continue to be generated.
Regardless of the monetary burden, Kiani expresses that he will not stop his fight against Apple until the latter treats smaller companies differently. AliveCor, who is also involved in a patent infringement battle with Apple, praised Masimo’s efforts and said that companies should be encouraged that industry giants are finally being held accountable for their actions.
“I feel like I have to do this. If I can change the most powerful company in the world from continuing to act badly, that’ll have more impact on the world than anything else I’m doing.”
When it comes to moral support, Kiani appears to have been a one-man army in his quest, as he stated that his friends and employees warned him of the risks that would materialize over the decisions he was going to take. The Masimo CEO says that people close to him called him crazy and that Apple has unlimited resources at its disposal, giving the California-based titan a massive advantage.
Thankfully, Masimo is no stranger to legal cases, as it won a seven-year patent skirmish with Nellcor in 2006. Nellcor was an unchallenged company at the time, providing pulse oximeters, so it is safe to say that Masimo has some experience in this regard. Kiani has also stated that he is open to settlement talks with Apple but has not mentioned an exact figure or other conditions that will allow him to end things amicably. From this angle, it looks as if this legal battle will stretch on for years.
